BALI VILLA ESCAPES PTY LTD TERMS AND CONDITIONS

 

Please read these terms and conditions carefully before using the Website operated by Bali Villa Escapes Pty Ltd.  By using the Website, the Client agrees to be bound by these Terms.

Bali Villa Escapes Pty Ltd on the Website provides an online platform through which Owners can advertise Villas for reservation. By making a reservation through the Website, the Clients enters into a direct, legally binding, contractual relationship with the relevant Owner. Bali Villa Escapes Pty Ltd sends the details of the reservation to Owner and sends the Client a confirmation email for and on behalf of the Owner and is not a party to the direct, legally binding, contractual relationship between the Client and the Owner.

1. PAYMENT TERMS

50% Deposit Payment to be paid with 48 hours of making the reservation.

 50% Balance Payment to be paid 40 days prior to check-in (Low Season & High Season) and 60 Days (Peak Season)

Where the booking is made less than 40 days before the check-in date (Low Season & High Season) or less than 70 days before the check-in date (Peak Season), the Deposit Payment AND the Balance Payment must be paid together within 48 hours of making the reservation.

Peak Season: 1 – 8 January 2020; 20 December 2020 – 8 January 2021;

High Season: Easter Week; 16 June – 30 September 2020; and

Low Season: All other 2020 dates.

2. BANK FEES, CHARGES AND OTHER TRANSFER FEES

Guests are requested to ensure they request their bank to include all relevant fees and charges so that the full amount of the payment is received by Bali Villa Escapes Pty Ltd (“BVE”). Any shortfalls due to the bank or other transfer fees will need to be addressed on arrival.

3. CREDIT CARD PAYMENTS AND EXCHANGE RATE FLUCTUATIONS

Please note Bali Villa Escapes Pty Ltd is required by Indonesian law to issue invoices in Indonesian Rupiah (IDR). The invoice guests receive from BVE is based on the median IDR exchange rate and includes a 3% credit card fee. Guests should be aware that when paying by credit card, a guest’s credit card provider buys IDR at rates that may be subject to significant fluctuation and they may also add significant fees for the transaction. BVE cannot control these variables. On some occasions currency fluctuations may favour the purchaser, however, on other occasions, there may be a significant increase from the amount of the invoice issued by BVE to the amount billed to the guest by the credit card provider.

Please also be aware that in assessing exchange rates, guests should not calculate conversions based on exchange rate sites which quote seller rates that are always significantly higher than the buyer rates which will be charged by their credit card provider. For an accurate assessment, guests should contact their credit card provider directly.

4. CHECK-IN & CHECK-OUT TIMES

Check-in Time: 2.00 pm

Check-out Time: 12.00 pm

Early Check-In and Late Check-Out

Please feel free to enquire about the availability of early check-in or late Check-out. Early check-in may be available at a partial daily rate, subject to other bookings. Late check-out may be available at a half daily rate up to 6:00 pm and at full daily rate after 6:00 pm, subject to other bookings.

5. AGE OF GUESTS BOOKING VILLA

Bookings cannot be made by, or on behalf of persons under the age of 20 years without prior agreement with BVE. If such bookings are made they may be cancelled by Bali Villa Escapes Pty Ltd according to the Cancellation Terms below.

6. NUMBER AND AGE OF VILLA GUESTS

It is the guest’s responsibility to ensure the number of adults and children staying in the villa is correctly stated in the confirmation letter. The number of guests must not exceed the number stated in the confirmation letter without prior approval from Bali Villa Escapes Pty Ltd. Infants (<4yo) and children (<12yo) may stay in their parent’s room free of charge however not all bedrooms can accommodate extra beds and no bedrooms can accommodate more than one (1) extra bed and one (1) cot.

7. GUESTS TO PROVIDE PASSPORT AT CHECK-IN

In accordance with Indonesia Law, all guests are required to make their passport available to be copied at check-in.

8. USE OF THE POOL

Guests wishing to use the pool before 7.00 am or after 10.30 pm must take care to avoid disturbing other holidaymakers and local residents.

Children using the pool should be supervised by a responsible adult at all times. Please note that villa staff are often not able to swim and should not be relied upon to supervise children in the pool. Pool fences can be supplied on request at a daily rate.

Glass items are not permitted in the pool area as broken glass will require draining of the pool.

The pools are professionally maintained and guests should not interfere with the pool pump or other equipment or chemicals. On rare occasions, it may be necessary for BVE to attend and apply additional pool chemicals which may temporarily prevent the use of the pool.

9. SMOKING

Smoking is not permitted in the villa’s indoor areas. Ashtrays are provided for guests to smoke in the villa’s outdoor areas.

10. PETS

Pets are generally not allowed but may be accepted by prior agreement with BVE.

12. EVENTS AND PARTIES

The total number of guests and invitees to the villa must not exceed 1.5 times the number of guests listed in the confirmation letter without prior approval from BVE.

Where the total number of persons attending the villa will exceed 1.5 times the number of listed guests, Bali Villa Escapes Pty Ltd Event Guidelines will apply and are available on request if you are considering a function or event.

12. CONDUCT OF VILLA GUESTS

The conduct of guests of the villa should not interfere with the enjoyment of other holidaymakers or local residents. Music or other noise should be kept to a minimum between 10.30 pm and 7.00 am, especially in the outdoor areas.

Where Police or Banjar (local community) attendance is required guests will be responsible to pay any penalties.

Bali Villa Escapes Pty Ltd reserves the right to terminate the booking where there is any serious breach of the Terms & Conditions, immediately and without refund.

13. DAMAGE, BREAKAGE OR LOSS

Guests are responsible for looking after the villa property and its inventory and will be responsible to pay for any damage, breakages or losses.

Bali Villa Escapes Pty Ltd reserves the right to terminate the booking where there is serious and deliberate damage to the villa property or its inventory, immediately and without refund.

14. Bali Villa Escapes Pty Ltd ACCESS

Bali Villa Escapes Pty Ltd reserves the right to access the premises to conduct urgent repairs or to respond to complaints about the conduct of guests of the villa. Bali Villa Escapes Pty Ltd will attempt to contact the guests prior to such attendances and arrange a convenient time where possible.

15. URGENT REPAIRS

Where the urgent repairs are likely to significantly interfere with the guest’s quiet enjoyment of the villa, BVE will arrange a similar or better alternative villa in consultation with the villa guests.

16. VILLA BECOMES UNAVAILABLE

Should the booked Villa become unavailable because it has been sold, withdrawn from the rental market, damaged or subject to renovation, Bali Villa Escapes Pty Ltd will use its best endeavours to relocate the guests to a similar or better villa in a similar location.

17. CANCELLATION TERMS

Cancellation of the reservation will result in forfeiture of the Deposit Payment.

The Balance Payment will be refunded ( less bank fees ) where the Cancellation has been made 30 days or more before the check-in date in Low Season & High Season, or 60 days or more before the check-in date in Peak Season.

Cancellation of the reservation less than 30 days before the check-in date (Low Season & High Season), or less than 60 days before the check-in date in Peak Season, will result in forfeiture of the Deposit Payment AND the Balance Payment.

18. TRAVEL INSURANCE

We strongly recommend guests take out comprehensive travel insurance at the time of booking to cover injury and illness (including repatriation), theft or loss of baggage and personal items, or cancellation of flights and accommodation.

19. LIABILITY

Bali Villa Escapes Pty Ltd is a marketing company that does not provide any accommodation services in the Villas and is not a travel agent. It is up to the Owners of the villas to offer accommodation services in the Villas to the Client and it is up to the Client to accept such accommodation services in the Villa. The service of Bali Villa Escapes Pty Ltd is to link the Client with the Owners but does not nor is it intended to provide accommodation services, travel agent services or any act that can be construed in any way as an act of an accommodation provider or a travel agent. Bali Villa Escapes Pty Ltd is not responsible nor liable for the acts and/or omissions of any Owner and/or any accommodation services provided to the client, nor any travel agent services provided to the client by any third party.

Bali Villa Escapes Pty Ltd shall not be liable for events beyond its control which may interfere with the guest’s scheduled occupancy, including but not limited to Acts of God, acts of governmental agencies, pandemics, fire, strikes, terrorism, war, inclement weather, flooding, disturbance or noise coming from outside the villas such as private or public construction, traffic, animals or neighbours. No refund will be offered by BVE in these circumstances.

Bali Villa Escapes Pty Ltd does not accept liability for any accidents or personal injury occurring at the villa property. Guests must take reasonable care for their own safety.

Bali Villa Escapes Pty Ltd does not accept liability for any loss or damage to guest’s property occurring at the villa property.

Bali Villa Escapes Pty Ltd does not accept liability for loss of rental time due to flight delays, cancellations, immigration issues, or any other travel problems. See also ‘Natural Disasters’.

Bali Villa Escapes Pty Ltd does not accept liability for the guest’s interpretation of the photographs and descriptions of villas on the BVE website or provided by BVE staff which are provided in good faith and intended to accurately describe and depict the subject villa.

Bali Villa Escapes Pty Ltd does not accept liability for any sudden failure of villa equipment, including pool equipment, but will take action to rectify any such failure as soon as possible after notification by the guest.

20. NATURAL DISASTERS

Guests who travel to Bali but their arrival is delayed by the closure of Denpasar Airport due to any form of natural disaster, will be refunded (less applicable bank fees) for those nights of accommodation lost due to their delayed arrival.

 Guests whose flights are delayed by their airline due to any form of natural disaster, in circumstances where Denpasar Airport remains open, will not be entitled to be refunded for those nights of accommodation lost due to their delayed arrival.

 Guests whose flights are cancelled by their airline due to any form of natural disaster, in circumstances where Denpasar Airport remains open will be entitled to reschedule their booking subject to:

The booking is rescheduled within 90 days of the original booking and not in Peak Season;

The same villa or another suitable villa is available; and

Where the rescheduled booking is made within a different seasonal period from the original booking the rates of charge will be adjusted according to the rates of the seasonal period to which the booking is rescheduled.

21. SIX (6) MONTHS PASSPORT VALIDITY REQUIREMENT

All foreigners entering Indonesia must have a valid passport with an expiration date not less than 6 months prior to their date of departure from Indonesia or entry will not be permitted.

22. Agency

Bali Villa Escapes Pty Ltd acts as a marketing agent for, and sell various villa holiday rentals as an agent on behalf of, numerous service providers. Any services we provide to you are collateral to that agency relationship. Our obligation to you is to (and you expressly authorise us to) make villa bookings on your behalf and to arrange relevant contracts between you and villa service providers. We exercise care in the selection of reputable service providers, but we are not ourselves a provider of villa services and have no control over, or liability for, the services provided by third parties.  All bookings are made on your behalf subject to the terms and conditions, including conditions of carriage and limitations of liability, imposed by these service providers.  We can provide you with copies of the relevant service provider terms and conditions on request.  Your legal rights in connection with the provision of villa services are against the specific provider and, except to the extent a problem is caused by fault on our part, are not against us.  Specifically, if for any reason (excluding fault on our part) any villa service provider is unable to provide the services for which you have contracted, your rights are against that provider and not against us.

23. VISA POLICY OF INDONESIA AND LENGTH OF STAY

Guests from most countries arriving at Ngurah Rai International Airport can enter Indonesia without a Visa and stay for up to 30 days (Please refer to http://www.indonesia.travel/en/post/visa-free-for-169-countries-to-travel-to-indonesia). Guests arriving by sea should check specific Visa requirements.

Guests wishing to stay in Bali for more than 30 days need to obtain a Visa on Arrival (VoA) from Immigration on arrival at Ngurah Rai International Airport, Denpasar for US$35 which is valid for 30 days and which can be extended once for an additional 30 days.

Clients who have made a villa inquiry from the website agree to receive a weekly email from Bali Villa Escapes about villa specials and villa news. If they no longer wish to receive a newsletter they can opt-out and will be taken off the list.

1) The exact Terms & Conditions which will apply to any particular Villa may vary.

2) Guests MUST refer to and rely on the exact Terms & Conditions which will be stated in the Bali Villa Escapes Pty Ltd Confirmation Letter that Guests will receive prior to confirming their booking.
